Limitation Of Liability

User Rules of Conduct

You agree to use the Site and (if applicable) the TVTonic Service in a manner consistent with all applicable laws and regulations. You understand that all information, data, text, software, music, sound, photographs, graphics, video, or messages (collectively, "Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not Wavexpress, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the TVTonic Service. Wavexpress does not control the Content posted via the TVTonic Service and, as such, does not guarantee legality, the accuracy, integrity or quality of such Content. You understand that by using the TVTonic Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Wavexpress be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed, transmitted or otherwise made available via the TVTonic Service. You acknowledge that you have read the TVTonic "Privacy Policy", and will engage in no activities which may undermine or threaten the application or integrity of such policy. Further, in connectiion with your use of the Site or the TVTonic Services, you may not:

g. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional Contents, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

j. interfere with or disrupt the TVTonic Service or servers or networks connected to the TVTonic Service, or disobey any requirements, procedures, policies or regulations of networks connected to the TVTonic Service;

k. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;

l. use any "robot", "spider" or other automatic or manual device or process for the purpose of compiling information on the Site for purposes other than for a generally available search engine;

m. create any link or hyperlink to any page of this Site; provided, however, that you may create a link to the home page of this Site with our prior written approval;

Chat Rules

In the event that you register for and obtain the TVTonic Service, you will have an opportunity to post and exchange information and opinions with other users of the TVTonic Service ("Chat Communications"). Be advised that Chat Communications do not necessarily reflect the views of Wavexpress, and in no event will we be liable for any claims, damages or losses relating to the Chat Communications.

You shall not post or exchange Chat Communications which contain: explicit or obscene language; language which infringe anyone else's intellectual property rights; discussions of illegal topics; personal attacks on other individuals; personal information about any minors; or other information that we, in our sole discretion, deem to be inappropriate for the TVTonic Service. Wavexpress does not undertake to monitor the Chat Communications except when explicitly identified on a specific Chat session, and therefore cannot be responsible for the views or opinions expressed by users. We reserve the right to edit or delete Chat Communications that violate these Chat Rules, as well as revoke the privileges of users who do not comply with the Chat Rules.

The terms of these Terms and Conditions are severable to the extent any term is deemed invalid, illegal, or unenforceable.

The failure of Wavexpress, to enforce any of these Terms and Conditions shall not be deemed a waiver thereof and shall not prevent its later enforcement.

These Terms and Conditions are governed by the laws of the State of New York, without respect to its conflict of laws principles. Jurisdiction for any claims arising under these Terms and Conditions shall lie exclusively with the state and federal courts located within the State of New York. You expressly consent to service of process in any such action by regular mail or by any other means provided by law. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
